Abstract:After the 18th national congress of the environment, President Xi put forward a major initiative to promote the reform of ecological civilization. It is undoubtedly a new requirement for local government environmental protection to strengthen local environmental protection and perfect ecological civilization construction mechanism. Local government should fully fulfill their environmental supervision and management responsibilities, strengthen the jurisdiction of the local government to the local environmental protection, careful analysis of problems in the course of duty, a sound system of relevant laws and regulations, so as to promote the construction of ecological civilization. At present, the provisions on the responsibility of environmental protection under the local government in our country is too principle, and scattered in various laws and regulations, against practice as the basis, could eventually lead to the local government cannot effectively perform environmental regulatory responsibilities. By studying the possible problems in the environmental protection regulation of local governments, this paper provides some perfect paths for the implementation of environmental supervision responsibilities of local governments in combination with the laws and regulations and the actual situation. This essay from the basic definition of local government environmental regulation, the government environmental protection supervision main content in order to promote environmental legislation, ensure the quality of environment, promote public participation, and strict environmental administrative law enforcement, shall perform their duties according to law. The necessity of the implementation of environmental protection responsibilities of local governments provides a stronger support for the government to better fulfill its environmental protection responsibilities under the new historical situation. The second part is "the legislative status and the analysis of the existing problems". Based on the current situation of China's legislation, the author analyzes the rights and obligations of local government environmental protection regulation on the legal level. Based on the environmental protection law, the relevant authorities and relief procedures of local governments in China are systematically studied, and the defects and deficiencies are clearly pointed out. This paper makes an in-depth analysis on the reasons for strengthening the environmental protection supervision responsibilities of local governments, and points out the importance and necessity of government environmental responsibility performance in combination with local government environmental supervision and legal responsibility. All at once, it analyzes the existing problems in the implementation of the environmental protection supervision of the Chinese government, and points out the direction for the targeted solutions to the government's environmental responsibilities. The third part is "the realization path of local government environmental protection regulation legal responsibility". The basic law, the legal regulation means and the after-the-fact supervision mechanism guarantee the path of the government's environmental responsibility. Firstly, the paper emphasizes the importance of environmental basic law to the government's responsibility for environmental protection, and puts forward Suggestions on the formulation and improvement of China's environmental law. Secondly, it discusses the relief procedures of government environmental supervision. Finally, it is recommended that public participation be incorporated into all aspects of local government environmental regulation.
