Abstract: Environmental education legislation is essential for our country at this stage. Through clear and reasonable environmental education legislation, can effectively improve or solve a series of environmental problems caused by the worsening environment of our country, can constantly enhance people's environmental protection awareness, more importantly, environmental education legislation can produce a very effective boost to the development of environmental education cause. Environmental education legislation can enable the people to combine the smooth embodiment of their own value and the healthy development of the natural ecological environment more closely and harmoniously, and also make the important concept of sustainable development become an important principle guiding people to correctly evaluate, judge and handle the harmonious relationship between man and nature, and then make the people realize that man and nature are inseparable interests and destiny The same body, the two complement each other and should coexist harmoniously. However, as far as the current legislation of our country is concerned, there is no special national environmental education law, and the system of environmental education laws and regulations is poor. Therefore, our country should carry out environmental education legislation, to improve or solve the increasingly harsh environmental problems, to provide a solid legal guarantee for environmental education. This paper is divided into four parts: First, the basic theory of environmental education is briefly sorted out, and the basis of environmental education legislation is clearly studied. Clarify the meaning, characteristics and purpose of environmental education, put forward the theoretical basis of environmental education legislation, and make the theory of sustainable development, risk prevention and citizens' environmental rights become the important theoretical support for the construction of environmental education legal system. Secondly, the article introduces and evaluates foreign environmental education legislation, which provides some reference for the construction of environmental education legislation in our country. This part briefly introduces the legislation of environmental education in the United States, Japan, Brazil and other countries and regions, and draws some commonalities in the legislation of these countries, such as ensuring the implementation of environmental education, clarifying the subject of environmental education, establishing environmental education guarantee and incentive system and so on. Thirdly, the necessity and feasibility of environmental education legislation in our country are analyzed. On the one hand, special legislation on environmental education can solve environmental problems, make up for the shortage of existing policy means, guarantee the implementation of environmental law and establish and improve the standard system of environmental education, so it is necessary to carry out special legislation on environmental education. On the other hand, China's environmental education legislation has already had certain conditions and basis, including the support of environmental education policy documents, the introduction of existing environmental education laws and regulations and the accumulation of practical experience in environmental education. To sum up, it is necessary and feasible to carry out environmental education legislation in our country at present. Finally, the author tries to construct environmental education legislation based on the experience of various countries and the actual situation of our country. Environmental education legislation should standardize environmental education specifically in the form of the Basic Law, that is, the Environmental Education Law, and establish a perfect legal system of environmental education. Clarify the legal level, legislative model, legislative purpose and legislative principle of environmental education law, and then reflect on the main body and scope of China's environmental education law, environmental education supervision system, environmental education guarantee incentive system, environmental education assessment system, environmental education talent training reserve system and environmental education legal responsibility and other basic contents. On this basis, further improve the departmental law and local legislation, so as to establish a perfect environmental education legal system.
